Welcome to Focufly. By downloading, installing, or using the Focufly iOS application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Focufly ("we," "us," or "our"). By using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Focufly is a daily planner application designed for neurodivergent individuals. The App provides:

• 9 color-coded planning sections (focus, priorities, schedule, habits, self-care, brain dump, reflection, productivity rating, and mood tracking)
• An XP (experience points) reward system
• Day history and navigation
• Bilingual support (English and Spanish)
• Local-only data storage

3. Free Trial

Focufly offers a 7-day free trial beginning from the first launch of the App. During the trial period, you have full access to all features. After the trial period expires, continued use of the App requires an active subscription.

4. Subscriptions & Payments

Focufly offers the following subscription plans:

• Yearly: $9.99 per year
• Monthly: $4.99 per month

Subscriptions are billed through Apple's App Store and are subject to the following terms:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscription in your Apple ID Account Settings.
• Any unused portion of a free trial period is forfeited when you purchase a subscription.

For refund requests, please contact Apple Support directly, as all payments are processed by Apple.

5. Your Data

All data you create in Focufly — including daily entries, habits, reflections, and settings — is stored locally on your device. We do not access, collect, or transmit your planner data. You are solely responsible for backing up your device. If you delete the App or your device data, your Focufly entries will be permanently lost unless included in an iCloud or device backup.

You can delete all Focufly data at any time through Settings → Delete All Data within the App.

6. Acceptable Use

You agree to use Focufly only for its intended purpose as a personal planning tool. You may not:

• Reverse engineer, decompile, or disassemble the App.
• Attempt to gain unauthorized access to any part of the App or its systems.
• Use the App in any manner that could damage, disable, or impair its functionality.
• Redistribute, sublicense, or resell the App or any portion thereof.

7. Intellectual Property

All content, design, code, graphics, logos, and trademarks within Focufly are the intellectual property of Focufly and are protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimer of Warranties

Focufly is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Focufly is a planning and organization tool and is not a substitute for professional medical, psychological, or therapeutic advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Focufly and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use or inability to use the App.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of applicable jurisdiction.

13. Apple's Standard EULA

In addition to these Terms, your use of the App is also subject to Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.
